On January 23, 1992, following a bench trial in the District Court of the First Circuit, the petitioner-appellant John G. Pone was convicted of criminal property damage in the fourth degree, a petty misdemeanor, in violation of Hawai'i Revised Statutes (HRS) § 708-823 (1985), for having intentionally damaged the front door of the complainant's apartment without his consent. Pone was sentenced to a fine of $25.00 and ordered to assume the cost of repairing the door. He appealed the conviction on the grounds (1) that the district court had erroneously denied his motion for judgment of acquittal at the close of the prosecution's case, pursuant to Hawai'i Rules of Penal Procedure (HRPP) 29(a) (1981),*fn1 and (2) that the evidence adduced by the prosecution was insufficient as a matter of law to support the district court's judgment of conviction. The Intermediate Court of Appeals (ICA) affirmed Pone's conviction in a published opinion. State v. Pone, No. 16081, slip op. (Haw. Ct. App. Jan. 21, 1994).
